EMF Sales Policy

Background

This policy statement has been created by Electronic Music Foundation (EMF) to disclose EMF's policy regarding sales of products, sales of tickets to EMF's events, contributions for benefits, and fees for services. EMF, a not-for-profit 501(c)3 organization, maintains a concert production office and studio in New York City and an administrative, publication, distribution, and archival center in Albany, New York State. Information relating to our structure and activities, including general contact information, is available at www.emf.org.

The following paragraphs state our policies as they relate to product sales and shipping of CDs, DVDs, books, software, and other products, whether conveyed by shipping or by downloads; your purchase of tickets to EMF's events; fees that you may pay for professional services; and contributions you may make to enroll as an EMF or LE Subscriber.

Product sales

All orders received by EMF are reviewed, approved, entered, and shipped by indivduals. All purchases of CDs, DVDs, books, software, or other products sold through CDeMusic, or any of EMF's distribution programs, are considered final, with the exceptions of defective or damaged goods, or products that have been shipped in error.

Payments for the products shipped, including associated shipping charges, are processed at the time of shipping.

All downloaded purchases, including software, are final.

Returns

The return of defective or damaged goods, or products that have been shipped in error, requires a Return Merchandise Authorization (RMA), as described in the following paragraphs.

In the case that a product is defective, you will need to report the issue to us within 30 days. If we can not assist you in the proper function of your purchased item, or if we determine that it is defective, we will provide you with an RMA for an exchange or credit at EMF's discretion.

If you receive a damaged package, you will need to file a claim with the carrier that delivered the package.

Any errors in your order must be reported within 30 days of the shipping date or date of package delivery. If we can verify the error, we will provide you with an RMA for an exchange or credit at our discretion.

EMF does not provide for, cover the cost of, refund, or offer any other type of compensation for the shipping costs for returned merchandise.  The customer is solely responsible for RMA shipping charges.

Special orders

The catalog maintained by EMF at the CDeMusic website represents specialized, niche, and sometimes custom-made products. Products listed in the CDeMusic catalog may become out-of-print or otherwise unavailable without notice.  EMF will use its best efforts to keep customers informed of the status of backordered items and items that have become unavailable.

In the event that an item within a larger order is backordered, we will use our best judgement as to whether to make a partial shipment of the order or wait for the backordered items to arrive before shipping the complete order. Some of the factors that will influence this decision are the immediate availability and estimated time of arrival for the backordered items, the number of backordered items in the order, and any noted urgency by the customer.

Prices may change without notice on special order items.  EMF will notify special order customers about price changes before processing payment.

Purchases for resale

EMF charges a 15% restocking fee on all CDs, DVDs, books, videos, and other printed materials, applicable only to dealers, resellers, stores, wholesale vendors, distributors, or any other business that is purchasing any quantity for resale.

Shipping policies

We use the United States Postal Service (USPS), UPS, and Fedex for shipping within North America. We use USPS Parcel Post Air, International Express Mail (EMS), Fedex, or UPS for international shipping.  Our decisions as to which carrier to use are based on order size, value, destination, and which carrier in each specific case provides the most cost-effective and secure (insurable and/or trackable) method of shipment.

Customers may request specific carriers when the options are available for that area.

Customers may request less expensive and non-secure methods of shipping but will assume responsibility for replacement costs if the shipment is lost or damaged.

We will NOT ship by surface on international orders.

If an order is returned to us because the shipping address we were given is incorrect, we will either (1) refund the value of the products in the order, not incuding the shipping charge, or (2) re-ship the order to a new confirmed address with a new shipping charge.

EMF is not responsible for customs charges or delays in customs. If customs charges are a concern, we recommend that customers divide large orders into smaller orders spread out over several days to help reduce large customs charges.

Shipping rates

We calculate our shipping charges in units, quantities, and destinations. A unit is the size and weight of a compact disc.

Within the United States. For orders under $50, we use First Class Mail or UPS.  For orders above $50, we ship by UPS or another trackable and insurable service. The shipping charge for a 1-unit item shipped by USPS (US Postal Service) to a destination within the United States is $3, with each additional unit at $1.50. UPS charges vary widely depending on weight and region.

International orders. For orders under $50, we ship quantities of 1-2 units by regular air mail. Orders with quantities of 4 units or more, or where the value is greater than $50, will be shipped either by Parcel Post Air or EMS.  Very large or expensive orders, or certain special order items, may be shipped by either FedEx or UPS with shipping charges calculated per order. Examples of typical shipping charges are as follows: The shipping charge for a 1-unit item shipped by air mail to Canada is $4 with each additional unit at $1.50. The shipping charge for a 1-unit item shipped by air mail to Mexico is $4 with each additional unit at $2.50. The shipping charge for a 1-unit item shipped by air mail to Europe, South America, Africa, and mainland Asia is $6 with each additional unit at $3. The shipping charge for a 1-unit item shipped by air mail to Australia, Japan, and New Zealand is $7 with each additional unit at $3.

Shipping charges are not refundable.

Tickets to events

When you purchase a ticket to attend an EMF event, your purchase will be final.

Contributions

We invite any individual or organization that is involved professionally in music, sound art, or media art to become an EMF Subscriber by making a one-time contribution of $100 or to become an LE Subscriber by making a one-time contribution of $25. These contributions are non-refundable. They may be tax deductible as a professional subscription or as a donation.

Fees for services

The fees you may pay for specific services, such as the rental of studio time, recording fees, advertising, or any other professional services that we may provide, will be determined by specific agreement.
